1. INTRODUCTION
These Terms of Use govern your engagement with Alex Hunt, trading as Pixel87, for design services. By booking a discovery call, requesting services, or engaging in any project with me, you agree to be bound by these terms.
If you do not agree to these terms, you may not use my services.
2. SERVICES
I provide UI/UX design, product design, branding, and related creative services as described on my website and agreed upon in individual project briefs.
All services are provided on a project basis. Each project scope, timeline, and deliverables are confirmed in writing before work begins.
I reserve the right to decline any project or request that falls outside my scope of practice or conflicts with my professional judgment.
3. ENGAGEMENT & DISCOVERY CALLS
Initial discovery calls via Bloom.io are complimentary and non-binding. These calls are to understand your needs, discuss approach, and determine if we're a good fit. Following discovery, I will provide a formal proposal outlining scope, timeline, deliverables, and investment.
Work does not commence until you have agreed to and signed the proposal or service agreement.
4. PROJECT SCOPE & CHANGES
All projects are scoped individually based on our discussions and written agreement.
If you request changes to the agreed scope during a project, I will notify you of the impact on timeline and investment before proceeding.
Scope creep (significant changes beyond the original agreement) may incur additional fees.
5. PAYMENT TERMS
For project-based work:
• 50% deposit is due before work begins
• 50% balance is due upon delivery of final deliverables
For ongoing/retainer partnerships:
• A flat monthly fee is agreed in advance
• Invoices are issued on the first of each month
• Payment is due within 7 days of invoice
All invoices must be paid in full before further work is undertaken. Late payment may result in suspension of services.
Prices are in GBP unless otherwise stated. VAT (if applicable) will be added to invoices.
6. TIMELINE & DELIVERY
I will provide realistic timelines based on project scope. Typical project phases are:
• UX Foundation: 1-2 weeks
• Full Product Experience: 3-5 weeks
• Brand and Product Experience: 6-8+ weeks
Timelines are estimates and may vary based on your feedback, availability, and scope complexity.
I will provide regular updates and maintain communication throughout the project. You will have access to live Figma files during design phases.
Delays caused by your unavailability or delayed feedback may extend timelines.
7. REVISIONS & FEEDBACK
Each project phase includes up to two rounds of revision. This ensures focused, efficient feedback cycles.
Revision requests should be clear and actionable. Feedback that fundamentally changes the project direction may be considered scope creep.
Additional revisions beyond the included rounds will be charged at my standard hourly rate.
8. INTELLECTUAL PROPERTY & OWNERSHIP
All final design deliverables and files created under our agreement are transferred to you upon receipt of full payment.
You retain all intellectual property rights to the final deliverables and may use them for any lawful purpose.
I retain the right to use anonymized project work in my portfolio and case studies (unless an NDA specifies otherwise).
Any pre-existing assets, templates, or tools I use remain my intellectual property. However, you retain the right to use any customisations made during our engagement.
If you request confidentiality, I offer NDA protection upon request at no additional cost.
9. CONFIDENTIALITY
I will keep all project information, business details, and communications confidential unless you consent to sharing.
I will not disclose your project publicly without your permission, except as permitted under portfolio/case study terms (see Section 8).
You agree to keep my process, methodology, and pricing confidential.
10. COMMUNICATION & AVAILABILITY
I typically respond to emails and messages within 1-2 working days during active projects.
I work Monday to Friday and may have limited availability on weekends or holidays.
You can reach me via email (alex@pixel87.co.uk), Teams, Google Meet, or other agreed channels.
Regular check-ins are scheduled to keep projects aligned and moving forward.
11. LIABILITY & DISCLAIMERS
I provide design services based on my professional expertise and your brief requirements. Design outcomes depend on factors beyond my control, including implementation, user behaviour, and market conditions.
I am not liable for:
• Business outcomes or revenue impact from design work
• Decisions you make based on my recommendations
• Third-party service performance (e.g., hosting, analytics tools)
• Loss of data, unless caused by my gross negligence
My liability for any claim arising from our engagement is limited to the total amount paid for the specific project in question.
I am not responsible for delays caused by your feedback delays, scope changes, or third-party dependencies.
12. YOUR RESPONSIBILITIES
You agree to:
• Provide accurate, complete project briefs and information
• Make timely decisions and provide feedback within agreed timeframes
• Ensure you have authority to commission the work
• Provide any existing assets, content, or brand materials needed
• Implement delivered designs professionally
• Respect confidentiality agreements
Delays caused by your unavailability may extend project timelines at no additional cost to you.
13. CANCELLATION & REFUNDS
If you cancel a project before work begins, your deposit will be fully refunded.
If you cancel during an active project phase:
• You are responsible for payment of work completed to date
• A pro-rata refund of unused fees may be offered at my discretion
If I must cancel due to circumstances beyond my control (illness, emergency), I will provide a full refund of any unused fees.
Refunds are processed within 14 days of cancellation.
14. ACCESSIBILITY & COMPLIANCE
I design with accessibility in mind, following WCAG 2.1 standards. However, final accessibility compliance depends on accurate implementation by developers.
I can advise on accessibility best practices, but I am not responsible for implementation or compliance after handover.
For regulated industries (healthcare, finance, etc.), additional compliance requirements should be discussed upfront.
15. DISPUTE RESOLUTION
If a dispute arises, we will attempt to resolve it through good-faith discussion and negotiation.If negotiation fails, either party may pursue legal action under the laws of England and Wales.
Any legal proceedings will be brought in the courts of England and Wales.
16. LIMITATION OF LIABILITY
Neither party will be liable for any indirect, incidental, special, or consequential damages arising from this agreement.
Both parties' total liability is capped at the amount paid for the specific project in question.
17. TERMINATION
Either party may terminate a project with written notice. Termination terms depend on the stage:
• If not started: Full refund of any deposit
• If in progress: Payment for completed work; pro-rata refund of unused feesUpon termination, I will provide all completed files and materials.
18. INDEPENDENT CONTRACTOR
I am an independent contractor, not an employee. This agreement does not create an employment relationship.I am responsible for my own taxes, insurance, and business expenses.
19. MODIFICATIONS TO TERMS
I may update these Terms of Use periodically. Changes will be posted on my website with a new "Last Updated" date.
Continued engagement with me after changes constitutes your acceptance of revised terms.If you disagree with changes, you may decline to engage in future projects.
20. ENTIRE AGREEMENT
These Terms of Use, along with any project proposal or service agreement, constitute the entire agreement between us.
Any previous communications or negotiations are superseded by this written agreement.
No modification of these terms is valid unless agreed in writing.
21. SEVERABILITY
If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full force.

23. GOVERNING LAW
These Terms of Use are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
Any legal action or proceeding arising under these terms will be brought exclusively in the courts of England and Wales.
